Terms of use

This is the agreement between you and us about using ChalkyBoard. We have tried to write it in ordinary language. It is still a contract, so please read it.

The short version. Your work is yours. Use ChalkyBoard for lawful things, do not try to break it or copy it, and be careful about what you send to other people. During the beta everything is free and things will change. We can only promise the service as it is, not that it will never break.

1. Who this is between

ChalkyBoard is a service of Answers Tutoring LLC, trading as College Prep System, of 3735 Franklin Rd SW #120, Roanoke, VA 24014 ("we", "us"). By creating an account or using the service you agree to these terms. If you are agreeing on behalf of a school or a company, you confirm that you are allowed to bind it, and "you" means that organisation.

2. You have to be an adult

You must be 18 or over to have a ChalkyBoard account. The service is not offered to children and you may not create an account for one.

A child may join a lesson through a link you send and draw on your board. If you invite anybody under 18 into a session, you confirm that you have the right to work with them, and you are responsible for what happens in that session. We never ask them for personal information and there is nowhere in ChalkyBoard to store any.

3. Your account

Keep your password to yourself. Anything done through your account is treated as done by you. Tell us at once if you think somebody else has got into it.

One person per account, except on Team, where each person gets their own seat. Do not share a single login between several people.

4. Your work belongs to you

Everything you draw, type and upload stays yours. We claim no ownership of it.

You give us only the permission we need to run the service for you: to store your work, to show it back to you, to send it to the people you tell us to send it to, and to display it to somebody you have invited into a live session. That permission ends when you delete the work or the account.

You confirm that you have the right to upload what you upload. Do not upload material that belongs to somebody else unless you are allowed to.

ChalkyBoard is currently in a free beta.

7. Plans, storage and payment

Free accounts include a storage allowance, shown in the product. When it is full, saving stops until you free some space or move to a paid plan. Nothing already saved is deleted because you reached the limit.

Paid plans are billed in advance, monthly or annually, through Stripe. Team is billed per seat. Prices are shown before you buy and we will give you notice before changing them.

You can cancel at any time and you keep what you paid for until the end of the period you have already paid. We do not give partial refunds for time you have not used, except where the law requires it or where something on our side went badly wrong, in which case write to us and we will sort it out.

If a subscription ends, your account moves back to Free. Your work stays for one year and is then permanently deleted, as described in the privacy page.

8. Emailing work to other people

ChalkyBoard can email the boards from a session to somebody else. When you use it, you confirm each time that the address belongs to an adult who is 18 or over, that you have their permission to email them, and that nothing in the boards is inappropriate. That confirmation is recorded with the send.

You may send to more than one address at a time, up to five, and ChalkyBoard remembers the addresses you have used for a student so you can pick them again. Each one is confirmed the same way the first was, and you can remove any of them from the same panel.

You are responsible for the addresses you type and for what the boards contain. If somebody tells us they should not have received a message, we will stop sending to that address.

9. Stopping

You can close your account whenever you like. We can suspend or close an account that breaks these terms, and for anything involving a child or a serious security problem we will do it immediately and without notice. Otherwise we will tell you what the problem is and give you a chance to fix it.

If a paid plan ends and is not renewed, your work is kept for a year and then removed. We will email you at least fourteen days before that happens, saying what will go and on what date, and starting a plan again at any point before it stops the clock. If we cannot reach you, nothing is removed until we have. There is more detail in the privacy notice.

If we ever discontinue ChalkyBoard, we will give you reasonable notice and a way to download your work first.

10. What we promise, and what we do not

We will run the service with reasonable skill and care. We will not read your boards except where we genuinely need to in order to fix a problem you have reported or to comply with the law.

Beyond that, the service is provided as it is. We do not warrant that it will be uninterrupted, that it will never lose data, or that it will suit a particular purpose. Keep your own copy of anything you cannot afford to lose. ChalkyBoard can download any board as an ordinary PDF, and we recommend using it.

11. Liability

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited by law.

Subject to that, we are not liable for indirect or consequential loss, for lost profits, or for lost data beyond restoring what we hold. Our total liability to you for any claim is limited to the greater of the amount you paid us in the twelve months before it arose, or fifty US dollars.

You agree to cover us for claims arising from your use of the service in breach of these terms, including anything you upload or send.

12. Changes

We may update these terms. For a change that materially affects you we will give at least thirty days' notice by email or in the product, and if you do not accept it you may close your account and we will refund the unused part of anything you have paid.

13. Law

These terms are governed by the laws of the Commonwealth of Virginia, and the courts of the Commonwealth of Virginia have exclusive jurisdiction, except that either of us may seek an injunction anywhere. If any part of this agreement is unenforceable, the rest still stands.
